Privacy Notice

This notice explains how Codeaway Software Ltd, trading as ChowMeister, handles personal information relating to customers, food businesses, applicants and other users.

1. Who is responsible for your information?

2. Information we collect

Depending on how you use ChowMeister, we may process:

  • identity information such as name and account identifiers;
  • contact details such as email address and telephone number;
  • delivery and collection addresses;
  • location information where you choose to use a location feature;
  • order history, items, fulfilment details and transaction records;
  • refund, complaint and support information;
  • reviews and other submitted content;
  • device, browser, security and IP information;
  • authentication and account-security data;
  • Seller business, identity, address and compliance information;
  • Seller payout, transaction and earnings information;
  • Seller declaration and compliance-check history; and
  • information from public authorities or public food-hygiene registers where relevant to Seller verification.

3. Allergy and health-related information

Information about allergies or medical conditions can be particularly sensitive.

Where ChowMeister provides a feature specifically allowing you to submit allergy or health-related information, we will use it only for the stated purpose, such as communicating relevant information to the food business, and will use an appropriate legal basis for that processing.

Please do not place unnecessary medical information in general free-text fields.

4. Why we use personal information

We may process information to:

  • create and secure accounts;
  • authenticate users;
  • process and manage orders;
  • facilitate payments and refunds;
  • provide delivery or collection information;
  • operate Seller accounts;
  • conduct food-business and compliance checks;
  • detect and prevent fraud or abuse;
  • handle complaints and support requests;
  • maintain platform security;
  • comply with tax, accounting, regulatory and legal obligations;
  • improve and operate ChowMeister; and
  • send marketing where permitted by law.

5. Our legal bases

Depending on the processing activity, we rely on one or more of:

  • Contract — where processing is necessary to provide the service you request.
  • Legal obligation — where we must process information to comply with law.
  • Legitimate interests — for purposes such as security, fraud prevention, service improvement, dispute handling and protecting ChowMeister and its users, where those interests are not overridden by your rights.
  • Consent — where the law requires consent, including certain marketing, optional tracking or sensitive-information processing.

6. Marketing and local recommendations

Marketing emails are optional. We will not turn marketing emails on simply because you create a ChowMeister account.

If you choose to receive marketing emails, we may occasionally contact you about new kitchens, menus, offers and other food available in your area.

To make these messages locally relevant, we may use information you have provided to ChowMeister, such as your saved delivery address, postcode or selected location, to determine whether a kitchen or offer is available around your area.

Where our marketing relies on your consent, you can withdraw that consent at any time. Turning marketing emails off will exclude you from future optional marketing campaigns.

You can manage this setting from your Email preferences.

Marketing preferences do not prevent us from sending necessary service communications, such as order, account, security, refund or other operational messages relating to your use of ChowMeister.

7. Who we share information with

We may share information where reasonably necessary with:

  • the food business fulfilling your order;
  • payment processors;
  • authentication providers;
  • hosting and database providers;
  • email and communications providers;
  • delivery providers where delivery is arranged through the Platform;
  • fraud, security and technical providers;
  • accountants, lawyers, insurers and professional advisers;
  • regulators, tax authorities, courts and law enforcement where required or permitted by law; and
  • a buyer, investor or successor where our business or relevant assets are reorganised or transferred, subject to appropriate safeguards.

Our current technology providers may include services used for authentication, payments, hosting, cloud infrastructure, databases and communications.

8. International transfers

Some technology providers may process information outside the United Kingdom.

Where required, we use an appropriate lawful transfer mechanism or rely on another legally permitted safeguard.

9. How long we keep information

We keep personal information only for as long as reasonably necessary for the purpose for which it was collected, including legal, tax, accounting, fraud-prevention and dispute-resolution requirements.

Core order and contractual records may normally be retained for up to six years after the relevant transaction or end of the relationship, unless a longer or shorter period is appropriate or legally required.

Security records, unsuccessful verification data and other operational information may use different retention periods based on risk and necessity.

10. Seller information and tax reporting

ChowMeister may be required to collect and verify information relating to Sellers and marketplace transactions.

Where applicable law requires reporting to HMRC or another tax authority, we may provide legally required Seller identity, tax, payment and transaction information.

11. Your rights

Depending on the circumstances, you may have rights relating to:

  • access to your personal information;
  • correction of inaccurate information;
  • erasure;
  • restriction of processing;
  • data portability;
  • objection to certain processing; and
  • withdrawal of consent where processing relies on consent.

These rights are not absolute and may be subject to legal exceptions.

12. Complaints

Please contact us first if you have concerns about how we use your information.

You also have the right to complain to the UK Information Commissioner's Office where applicable.

13. Security

We use technical and organisational measures intended to protect personal information against unauthorised access, loss, misuse and disclosure.

No internet service can guarantee absolute security.

14. Changes to this notice

We may update this Privacy Notice as our processing, technology or legal obligations change.

Material changes will be brought to users' attention where appropriate.
